unconscionability business definition

Legal defense against the enforcement of a contract that is so one-sided that a normal person would find it unconscionable. For example, an elderly person signs a contract for repair of a roof at a cost much higher than would be charged by a reputable contractor. Unconscionability results from an unfair bargaining position that may be related to a variety of factors, including a language barrier or mental frailty.
