merchant's privilege business definition

The legal right of a merchant, or someone acting on behalf of the merchant, to detain for a reasonable time individuals suspected of unlawfully taking the merchant's property. The merchant may confiscate merchandise in plain view, but generally is not permitted to search the detainee. Rules applicable to detention, search, and other aspects of merchant's privilege vary by state. See also civil recovery.
