merchant's privilege business definition

The legal right of a merchant, or someone acting on behalf of the merchant, to detain for a reasonable time individuals suspected of unlawfully taking the merchant's property. The merchant may confiscate merchandise in plain view, but generally is not permitted to search the detainee.
